TERMS AND REGULATIONS

§1

These Terms and Conditions set out the terms that apply to all reservations, bookings and agreements of accommodation. Submitting a reservation confirms acceptance of the terms and conditions contained herein. The Agreement of Accommodation shall be deemed entered into upon the acceptance of the Client's booking

§2

Reservations, confirmation of reservations and cancellation:

1.The Client shall submit the reservation by phone or by e-mail. The Proprietor shall check availability and dates for the room the Client enquires about. In case the room is available, the Proprietor shall send a confirmation of the reservation to the e-mail address provided by the Client. The e-mail confirmation of the reservation shall contain the charges payable by the Client, payment period and the bank account number to which the payment should be transferred. Confirmation of the provisional reservation shall be sent to the e-mail address provided by the Client within 24 hours of the receipt of the reservation. The provisional reservation shall remain valid for the period of 24 hours of the receipt of the reservation. The reservation becomes definitive by receipt of the deposit of thirty percent (30%) of the total charge. The deposit shall be transferred by the Client to the Proprietor's bank account provided in the e-mail confirming the reservation. Failure to pay the deposit within the indicated time period shall result in reservation cancellation. The final confirmation of the reservation shall be sent after the receipt of the deposit to the e-mail address provided by the Client. The remaining amount of the total charge shall be paid by the Client upon arrival in cash.

2.The client is entitled to cancellations in which case the Proprietor must be immediately notified.

3.In the event of cancellation within 14 days of arrival, the Client is entitled to a refund of fifty percent (50%) of the aforementioned deposit. If the cancellation is made within less than 14 days of arrival, the deposit paid is non-refundable and the 30% deposit charge shall be borne by the Client.

4.Accommodation charges are not refundable for early departures.

§3

Arrival, room keys, check-out time:

1.Check-in time is 02:00 pm on the day of arrival. Check-out time is 11:00 am on the day of departure.

2.The Client shall notify the apartament employee responsible for providing him/her with the key about the time of his/her arrival two hours before the arrival at the latest.

3.In case the Client is unable to arrive at the hotel at a previously agreed time, the hotel employee responsible for providing the Client with the key shall be immediately notified about it by phone. The Customer shall pay the charge amount quoted in the reservation confirmation in case of a late arrival or early departure which result from reasons beyond the Proprietor's control (e. g. the Client's personal reasons, transportation issues, strikes, etc.).

4.The Client shall return the key to the Proprietor upon departure. In case of loss or damage of the key the Client shall pay a 100 zł charge.

6.Check-in and check-out take place in the presence of the Proprietor or persons authorised by the proprietor.

§4

Charges and Services

1.The charges quoted are for the apartament for 4 persons.

2.The charges quoted include basic hotel services: bed linen change every seven days, room cleaning and towel change every 7 days and room cleaning upon check-out.

3.Unscheduled cleaning of the room can be done upon request with additional charges. The service must be ordered one day in advance

4.All charges quoted are gross and include 7% VAT.

5.The Proprietor reserves the right to request a safety deposit from the Client in the amount of 1000 zł. The safety deposit is returned to the Client upon departure.

§5

Liability of the Proprietor and of the Client

1.The Proprietor shall provide the Client with accommodation conditions ensuring unrestrained stay in the room.

2.The Client undertakes to behave in an orderly manner and shall keep the room in proper order. The Client shall immediately notify the hotel employee responsible for providing the Customer with the key about any damages or missing items in the room upon check-in. The Customer shall notify the Proprietor about any damages caused by him/her. The Client shall undertake to pay restitution for the making good of any material damage to apartament property caused by him/her.

3.Room occupancy is limited to the number of persons specified in the offer, price list or confirmation of the reservation.

4.The Proprietor does not allow pets in the apartment.

5.The Proprietor shall not be held liable for any damage to or loss of Client's property happening in the apartment.

6.The Client shall not be entitled to assign the booking to any third party nor utilise the hotel facilities other than for the stated purpose without the Proprietor's prior permission.

7.The Client shall keep the level of noise to an acceptable minimum particularly during the so called 'quiet period' which is fro 10:00 pm to 06:00 am. In the event other Clients require intervention of the person responsible for providing the Client with the key or the police intervention is necessary as the effect of the Client's loud behaviour, the Proprietor reserves the right to terminate the accommodation contract immediately without being liable for any refund or compensation.

8.In the event the Client blatantly disregards other Clients' peace and/or their individual rights or disregards commonly acceptable code of behaviour, the Proprietor reserves the right to terminate the accommodation contract immediately without being liable for any refund or compensation.

§6

Data Protection

By making a reservation on line the Client gives permission to the Proprietor to use his/her personal data for the booking process and registration purposes in compliance with the Data Protection Act (ustawa z dnia 29.08.1997). The Client has the right to check and delete his/her personal data.

§7

Governing Law

Any disputes between the Client and the Proprietor shall be governed by and construed in accordance with the laws of Poland. Any disputes shall initially be settled amicably out of court. In case out-of-court settlement is not reached, the Client agrees to submit to the Courts of competent jurisdiction determined by the Proprietor's location. The Proprietor certifies that he/she has read and accepted the terms and conditions contained herein. Any disputes not resolved by the terms and conditions contained herein shall be governed by and construed in accordance with the Civil Law of Poland and other laws that may apply.
